Clarksville contractor accused of fraud, stealing thousands from victims

CLARKSVILLE, Tenn. (CLARKSVILLENOW) – A Clarksville-based contractor has been charged with fraud, theft, and deceptive business practices after allegedly stealing thousands of dollars from his victims. According to an arrest warrant, 44-year-old Donald Givens was hired by the first victim to build a two-car garage with a loft at the victim’s residence for a total cost of $44,000 at the beginning of April 2016. Givens was conducting business as ‘Givens Remodeling’, also known as ‘Donnie Givens and Catherine Schafer’. The victim wrote Givens a check for $11,000 on April 13, but made it out to Cathy Schafer, who Givens said was his bookkeeper and girlfriend. Givens requested a second payment for $11,000 on May 9. The warrant states that at this point, two trees had been cut down and footers were built for the garage, but nothing else had been completed. The victim told police he contacted Givens several times about the incomplete work and received multiple excuses from him. He then contacted the Montgomery County Sheriff’s Office on Aug. 16 to report the incident. Givens failed to complete the work and denied the victim’s written request for a refund on September 15. After failing to get his money back, the victim contacted the District Attorney’s Office. A second victim reported to Clarksville police that she met Givens at a gas station and gave him a check for $1,700. The check was half of the total payment for repairs to the victim’s home, which were to be completed by July 15. The check was cashed the same day, but Givens did not show up on the arranged date to perform the repairs, according to the victim. She contacted Givens and he agreed to reschedule, but still did not arrive on the agreed upon date. The victim sent Givens a certified letter which he signed, but did not respond to. She then contacted the Clarksville Police Department on September 16. A detective called Givens on Oct. 17. He told the detective he received the payment and intended to perform the job, but had not had the availability and would return the money to the victim. However, the victim had not received a refund as of Nov. 9 and contacted police again. Givens was arrested Jan. 10, 2017 and charged with contractor fraud, theft, and deceptive business practices. His bond was set at $200,000.
